Terms of Service

1. Acceptance of Terms

By accessing or using SidekickCal, you agree to be bound by these Terms of Service and all applicable laws and regulations in New South Wales, Australia. If you do not agree, please do not use the service.

2. Description of Service

SidekickCal is a Software-as-a-Service (SaaS) platform that allows Organizations (“Orgs”) to push event updates to Subscriber calendars. We act as a bridge between the Org's schedule and the Subscriber's personal calendar.

3. User Accounts

• Orgs: You are responsible for the accuracy of the fixture data you provide. You must own or have permission to use any logos or branding uploaded to the platform.
• Subscribers: By clicking “Sync,” you grant SidekickCal permission to write and edit events on your primary calendar. We will never read or modify your personal, non-SidekickCal events.

4. Billing and Payments

• SidekickCal utilizes our payment processor to handle all transactions securely.
• Subscriptions are billed in advance on a recurring basis.
• Cancellations take effect at the end of the current billing cycle.
• Unless required by Australian Consumer Law, all fees are non-refundable.

5. Intellectual Property

SidekickCal and all associated software, branding, logos, and content are the property of SidekickCal (registered business name). All rights are reserved. You may not copy, reproduce, distribute, or create derivative works from any part of the platform without our express written permission. Orgs retain ownership of their own fixture data and branding assets uploaded to the platform.

6. Prohibited Conduct

You agree not to use SidekickCal to:

• Push spam or non-sporting events to subscribers.
• Infringe upon the intellectual property of other sports organizations.
• Attempt to reverse-engineer the SidekickCal API or sync engine.
• Use the platform in any way that violates applicable Australian laws or regulations.

7. Termination and Suspension

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have breached these Terms of Service, engaged in fraudulent activity, or used the platform in a manner that may cause harm to others or to SidekickCal. Upon termination, your right to access the service ceases immediately. Any provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will do so.

8. Limitation of Liability

SidekickCal is provided on an “as is” basis. While we strive for 100% sync accuracy, we are not liable for any missed games, incorrect locations, or damages resulting from the failure of third-party calendar providers (Google, Microsoft, Apple) to display synced events.

9. Governing Law

These terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts in Sydney, NSW.

10. Modifications

We reserve the right to modify these terms at any time. Your continued use of the service following any changes constitutes your acceptance of the new Terms of Service.
